A: Yes, the health department does have the statutory authority to close a restaurant. A food establishment (restaurant) can be ordered closed for operating without a valid health permit, repeat violations of the Food Code, interference with the inspector in performing his/her duties, and if there is an imminent health hazard. Some examples of an imminent health hazard include no water, no electricity, inadequate refrigeration or evidence of a food-borne illness outbreak associated with the restaurant.
You can avoid closure of your restaurant by operating incompliance with the Food Code. In addition, if your restaurant looses power or water you can close your restaurant voluntarily until all utilities have been restored to working order. Developing a plan of action to respond to emergencies will help ensure the most effective response that will protect food products and help reduce profit loss.
